1. Scope
These Terms and Conditions apply to all contracts concluded via the FINE.GUIDE website between the operator and the customer. By purchasing digital products, the customer agrees to these Terms and Conditions.
2. Conclusion of the Contract
The presentation of digital products in the online shop does not constitute a legally binding offer but an invitation to place an order. By clicking the "Pay" button, the customer submits a binding offer to purchase the items in the shopping cart. The purchase contract is concluded as soon as the customer receives a confirmation email containing a download link for the purchased digital content.
3. Digital Products
The digital products offered on FINE.GUIDE include, among others, audio and video downloads as well as e-books. The provided content is for personal use only. The customer receives a simple, non-transferable usage right for the downloaded content. Each download link is limited to 10 downloads to prevent misuse. The operator reserves the right to add metadata to digital downloads to trace any unauthorized redistribution.
4. Delivery and Download
After successful payment via our payment provider Stripe, the customer will immediately receive a link to their order. The digital products and the invoice can be downloaded from there. It is the customer's responsibility to download the products within the specified number of downloads (max. 10 downloads per product).
5. Payment
Payment is made via the external payment provider Stripe. The customer agrees that their payment details will be transmitted to Stripe for transaction processing. The terms and conditions and privacy policies of Stripe apply.
6. Right of Withdrawal and Cancellation
In accordance with the provisions of the Austrian Distance and Off-Premises Transactions Act (FAGG), the right of withdrawal for digital content that is not delivered on a physical data carrier is excluded as soon as the customer has started the download and the contract has been fully fulfilled. The customer therefore waives their right of withdrawal once the download has begun.
7. Copyright
All texts, images, and digital content provided on FINE.GUIDE are protected by copyright. Use, reproduction, or distribution of the content in any form without the express written consent of the operator is prohibited. Violations of copyright will be prosecuted.
8. Disclaimer
The use of the digital products is at the customer's own risk. The operator is not liable for damages resulting from improper use of the downloaded content. The digital products and content are created to the best of our knowledge and belief. However, the operator assumes no guarantee for the accuracy, completeness, or timeliness of the content. The operator is not liable for any damages that may arise from the use of the provided content.
9. Final Provisions
Contracts between the operator and the customer are subject exclusively to Austrian law. Should individual provisions of these Terms and Conditions be invalid, the validity of the remaining provisions shall not be affected.

To analyze visitors, FINE.GUIDE uses the tool Google Analytics from Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland. The information collected through so-called cookies about the visitor is transmitted to Google's server and stored there. We have entered into a data processing agreement with the provider. We have activated Google Analytics’ IP anonymization feature by default, which sets the last digits of your IP address to zero.
